Michael Jordan Tells Court He Felt No Fear of Nascar in Legal Battle
Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his drive to win and novelty within the sport emboldened his push for 23XI Racing to “challenge” Nascar over alleged violations of antitrust rules.
Financial Stakes and a Competitive Drive
Jordan shared financial and corporate details of his 23XI team, saying he invested $40 million of his own funds into the Nascar Cup series team launched with partner Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar in its entirety. I felt as far as the sport required examination through a new lens.”
The Core Dispute: Charter Agreements and Renewal Demands
The heart of the case involves the expiration of a 2016 deal where Nascar provided each team a franchise. The concept is similar to other major leagues with separately owned franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar demanded teams renew their charters.
Jordan testified for about sixty minutes and left the court to a media frenzy, with onlookers and reporters clamoring for a view or a photo of the global icon.
Leading the Legal Charge
23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is breaking the law to maintain excessive control.
For Jordan and and Heather Gibbs, who preceded Jordan, are events from last September. Gibbs described a hectic and tense period where the sanctioning body informed teams they must sign a contract extension. The document consists of over a hundred pages outlining team compensation and a guaranteed entry in Nascar-sponsored races.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports decided their only feasible option was to decline to sign that extensive document and litigate the matter. All other teams agreed to the terms.
The team owners approached Nascar about potential amendments or negotiations. Nascar refused to engage, according to his testimony.
The Ultimate Motivation: Winning
Ultimately, the resistance against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Winning.
“Hamlin persuaded me getting a third driver improved our chances to win,” he said, noting that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I dove in.”

Gibbs described her push for indefinite franchises, which she said a formal letter to Nascar. She said the pressure of the signature deadline didn’t sit well.
According to her, Joe Gibbs first attempted to call and talk Nascar out of forcing signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, that’s what I have. If there are 30, that’s the number.”
